Colombia.<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element style=\"font-weight: 300;\">No siempre es el presupuesto. Tampoco es la falta de voluntad pol\u00edtica. Muchas veces, el verdadero cuello de botella en nuestras obras p\u00fablicas est\u00e1 en el dise\u00f1o del contrato.<\/span>\n\n<span style=\"font-weight: 300;\">Contratos mal estructurados, gen\u00e9ricos y poco funcionales abren la puerta a la ambig\u00fcedad, provocando paralizaciones, sobrecostos y arbitrajes que terminan desgastando a todos los stakeholders del proyecto.<\/span>\n\n<span style=\"font-weight: 300;\">Mientras en Colombia seguimos operando bajo modelos contractuales r\u00edgidos y desactualizados, Per\u00fa este a\u00f1o ha dado un paso estrat\u00e9gico al incorporar en su Ley General de Contrataciones del Estado (Ley 32069) la posibilidad de utilizar contratos estandarizados de ingenier\u00eda y construcci\u00f3n de uso internacional, como el NEC (New Engineering Contract) y FIDIC (F\u00e9d\u00e9ration Internationale des Ing\u00e9nieurs-Conseils).<\/span>\n\n<span style=\"font-weight: 300;\">Esta reforma no surgi\u00f3 de una teor\u00eda, sino de la experiencia exitosa que Per\u00fa acumul\u00f3 en los \u00faltimos a\u00f1os con los acuerdos de Gobierno a Gobierno (G2G) suscritos con pa\u00edses del Reino Unido y Francia. Es as\u00ed que, se suscribieron contratos del tipo NEC y FIDIC para ejecutar proyectos de envergadura como los Juegos Panamericanos y Parapanamericanos Lima 2019, Reconstrucci\u00f3n con Cambios 2020 y los Colegios Bicentenario 2021-2024.<\/span>\n\n<span style=\"font-weight: 300;\">En Colombia, el\u00a0Estatuto General de Contrataci\u00f3n de la Administraci\u00f3n P\u00fablica\u00a0(Ley 80 de 1993) no contempla ni regula expresamente los modelos contractuales tipo\u00a0NEC<\/span><b>\u00a0<\/b><span style=\"font-weight: 300;\">y FIDIC. No obstante, la Ley 80 de 1993 define los contratos estatales en forma general, abarcando\u00a0<\/span><i><span style=\"font-weight: 400;\">\u201ctodos los actos jur\u00eddicos generadores de obligaciones\u201d<\/span><\/i><span style=\"font-weight: 400;\">\u00a0celebrados por las entidades estatales que est\u00e9n previstos en el derecho privado o se deriven de la autonom\u00eda de la voluntad, enumerando \u00fanicamente a t\u00edtulo enunciativo algunas modalidades t\u00edpicas.\u00a0<\/span>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5d9ed70 elementor-widget elementor-widget-heading\" data-id=\"5d9ed70\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">\u00bfPor qu\u00e9 es tan importante esta reforma?\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-292fc97 elementor-widget elementor-widget-text-editor\" data-id=\"292fc97\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<span style=\"font-weight: 300;\">Porque estos contratos no son simples plantillas internacionales. Son herramientas de gesti\u00f3n contractual moderna, que:<\/span>\n<ul>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 300;\">Asignan los riesgos de forma clara y ex ante.<\/span><\/li>\n \t<li style=\"font-weight: 300;\" aria-level=\"1\"><span style=\"font-weight: 300;\">Incluyen mecanismos de resoluci\u00f3n temprana de disputas.<\/span><\/li>\n \t<li style=\"font-weight: 300;\" aria-level=\"1\"><span style=\"font-weight: 300;\">Promueven relaciones colaborativas entre las partes.<\/span><\/li>\n \t<li style=\"font-weight: 300;\" aria-level=\"1\"><span style=\"font-weight: 300;\">Fomentan la transparencia y la eficiencia operativa.<\/span><\/li>\n<\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2091ac0 elementor-widget elementor-widget-heading\" data-id=\"2091ac0\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Lo que est\u00e1 haciendo Per\u00fa y lo que Colombia a\u00fan no discute\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-87c8ee5 elementor-widget elementor-widget-text-editor\" data-id=\"87c8ee5\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<span style=\"font-weight: 300;\">Desde inicios del 2025, Per\u00fa permite el uso de contratos NEC y FIDIC en licitaciones p\u00fablicas. Esta apertura busca mejorar la calidad de los contratos, la ejecuci\u00f3n de las obras y la confianza de los inversionistas y ejecutores de los proyectos.<\/span>\n\n<span style=\"font-weight: 300;\">En Colombia, en cambio, a\u00fan prevalecen modelos contractuales dise\u00f1ados para otro contexto: m\u00e1s reactivos que preventivos, m\u00e1s formales que funcionales. Esto nos aleja de est\u00e1ndares globales y limita la participaci\u00f3n de operadores privados y multilaterales que exigen marcos modernos.<\/span>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-93e59fb elementor-widget elementor-widget-heading\" data-id=\"93e59fb\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">\u00bfQu\u00e9 estamos esperando?\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-141a9da elementor-widget elementor-widget-text-editor\" data-id=\"141a9da\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ul>\n \t<li style=\"font-weight: 300;\" aria-level=\"1\"><span style=\"font-weight: 300;\">\u00bfSeguir asumiendo los mismos errores de siempre en cada nuevo proyecto?<\/span><\/li>\n \t<li style=\"font-weight: 300;\" aria-level=\"1\"><span style=\"font-weight: 300;\">\u00bfContinuar redactando contratos desde el litigio, en lugar de desde la prevenci\u00f3n?<\/span><\/li>\n \t<li style=\"font-weight: 300;\" aria-level=\"1\"><span style=\"font-weight: 300;\">\u00bfAceptar que la par\u00e1lisis, las adendas y los sobrecostos son parte inevitable del sistema?<\/span><\/li>\n<\/ul>\n<span style=\"font-weight: 300;\">Los contratos NEC y FIDIC no sustituyen nuestra normativa, pero s\u00ed la fortalecen, alineando nuestras reglas con las mejores pr\u00e1cticas internacionales.<\/span>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-fcc0867 elementor-widget elementor-widget-heading\" data-id=\"fcc0867\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Si eres estructurador, abogado, funcionario p\u00fablico o contratista, esto tambi\u00e9n es contigo:<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9d2b1b2 elementor-widget elementor-widget-text-editor\" data-id=\"9d2b1b2\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ul>\n \t<li style=\"font-weight: 300;\" aria-level=\"1\"><span style=\"font-weight: 300;\">Porque el tiempo es dinero, y un contrato mal dise\u00f1ado cuesta a\u00f1os.<\/span><\/li>\n \t<li style=\"font-weight: 300;\" aria-level=\"1\"><span style=\"font-weight: 300;\">Porque una obra sin control contractual puede convertirse en una crisis jur\u00eddica y reputacional.<\/span><\/li>\n \t<li style=\"font-weight: 300;\" aria-level=\"1\"><span style=\"font-weight: 300;\">Porque el inversionista no volver\u00e1 si no percibe reglas claras y entornos legales confiables.<\/span><\/li>\n \t<li style=\"font-weight: 300;\" aria-level=\"1\"><span style=\"font-weight: 300;\">Porque un contrato robusto es el mejor blindaje para cualquier proyecto.<\/span><\/li>\n<\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8a13bf3 elementor-widget elementor-widget-heading\" data-id=\"8a13bf3\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Colombia tiene el talento, el marco jur\u00eddico y la urgencia.
